Terms of Service & Sale (EU & UK)
1) Eligibility & Account
You must be 18+ to place an order. You are responsible for safeguarding your account credentials and for any activity on your account.
2) Product Information (RC Models & Components)
RC models, batteries and accessories are hobby‑grade products requiring assembly, setup and safe operation. Always read manuals and follow safety guidance, especially for LiPo batteries (charge in a fire‑resistant area, use only compatible chargers, never leave charging unattended, inspect for damage or swelling, and dispose in accordance with local rules). Products should be used in compliance with local laws (e.g., airspace rules for drones/model aircraft, radio frequency limits, park/airport restrictions). We do not warrant suitability for professional, industrial or life‑critical uses unless expressly stated.
We try to describe products accurately; minor variations (packaging, firmware revisions, colours) may occur. Compatibility charts are guidance only—please check specifications before purchase.
3) Pricing, Taxes & Duties
Prices are shown in [GBP/EUR—choose one or show both]. Unless stated otherwise, UK prices include UK VAT; EU orders may show VAT collected at checkout or be Delivered Duty Unpaid with VAT/duties collected by the carrier on import. For EU orders ≤ €150, we may collect VAT via IOSS; otherwise, local VAT/duties may be payable on delivery. Any non‑standard delivery options or import brokerage fees are your responsibility. 4) Ordering & Contract Formation
Placing items in your cart or receiving an order confirmation email does not constitute acceptance. Your order is accepted when we dispatch the goods (we will email you). We may cancel and refund due to stock errors, suspected fraud, pricing mistakes, or export restrictions.
Pre‑orders/backorders. Dispatch dates are estimates and may change; you can cancel for a full refund before dispatch.
5) Payment
We accept payment via [insert providers, e.g., Stripe/PayPal/Adyen] and selected local methods. We do not store full card details. Payment is captured on order or upon dispatch depending on method.
6) Delivery, Risk & Title
- Territory & carriers: We ship to the UK and most EEA countries via [insert carriers, e.g., Royal Mail, DPD, UPS]. Lithium batteries and dangerous goods may face routing/method restrictions.
- Timeframe: Unless otherwise agreed, we deliver without undue delay and within 30 days of contract. If we miss an essential delivery deadline, you may cancel and obtain a refund. Risk passes on delivery to you (or your nominated person). Title passes when we receive full payment. (Legislation.gov.uk)
- Inspection: Please check parcels on arrival and report transport damage to us within 48 hours with photos.
7) Right to Cancel (Cooling‑off: UK & EEA Consumers)
For distance purchases you have the right to cancel within 14 days without giving a reason. The period starts the day after you (or your nominee) receive the goods. To exercise the right, notify us before the period ends (email or the Model Cancellation Form in Section 21). If we failed to inform you about this right, the period may be extended as provided by law. (EUR-Lex)
Refunds after cancellation. We will refund all payments received, including the standard outbound delivery cost, within 14 days of receipt of the returned goods or proof of return—whichever is earlier. You are responsible for return shipping costs unless we offer free returns. We may deduct for loss in value caused by handling beyond what is necessary to establish the goods’ nature and functioning (e.g., heavy use, damage). (Legislation.gov.uk)
Return method. Use our RMA instructions (Section 9). You must return the goods without undue delay and no later than 14 days after notifying cancellation.
Exceptions (no 14‑day cancellation) include, for example: goods made to your specifications or clearly personalised; sealed goods not suitable for return for health/hygiene reasons if unsealed after delivery; goods which, after delivery, are inseparably mixed with other items; digital content supplied non‑tangibly once download/streaming begins with your consent; services fully performed with your prior express consent acknowledging loss of withdrawal right; and other exceptions set by law. 8) Faulty, Misdescribed or Not‑as‑Agreed Goods
Your statutory remedies apply.
- UK (Consumer Rights Act 2015). If goods are faulty, misdescribed or not fit for purpose, you have a short‑term right to reject within 30 days for a refund; after that, you’re entitled to repair or replacement and, if unsuccessful, a price reduction or final right to reject. Burden‑of‑proof rules and time limits apply. (Legislation.gov.uk)
- EU/EEA. You benefit from a minimum 2‑year legal guarantee of conformity. Remedies generally include repair or replacement, and where appropriate, price reduction or rescission. National specifics may vary. (European Union)
These rights are in addition to any manufacturer warranty. Please contact us before returning potentially defective items so we can assist with diagnostics, parts or repairs.
9) Returns & RMA Process
To arrange a cancellation return, warranty repair or DOA exchange, please request an RMA via dmytro@modelcrate.shop. Pack items securely (include all accessories) and use trackable shipping. For cancellations, you are responsible for return costs unless we failed to disclose this before purchase or we agree otherwise. For faulty items, we cover reasonable return costs once fault is confirmed.
10) Promotional Codes, Bundles & Gift Cards
Promo codes can’t be combined unless we say so and don’t apply to taxes, shipping or excluded items. Gift cards are non‑refundable, non‑transferable and not redeemable for cash unless required by law.
11) Safety, Compliance & Use Restrictions
- Batteries. Follow LiPo safety practices; use compatible chargers; never puncture, crush, over‑discharge or charge unattended. Stop using swollen/damaged packs.
- Operating RC models. Keep safe distance from people/property; maintain line‑of‑sight; check local rules (e.g., registration, operator IDs, age limits, no‑fly zones, Remote ID where applicable).
- Firmware & mods. Modifications, non‑approved firmware or misuse may void warranties and create safety risks.
- Environmental. Dispose of WEEE and batteries responsibly under local rules. UK/EU guidance applies, including the crossed‑out wheeled‑bin symbol on EEE. (GOV.UK)
12) Export Controls & Sanctions
You must comply with all applicable export, import and sanctions laws. We may refuse or cancel orders to restricted destinations or entities.
13) Reviews & User Content
By submitting reviews, Q&A, images or videos, you grant us a non‑exclusive, royalty‑free licence to use such content on our site and marketing channels. Do not post unlawful, defamatory, hateful, infringing or unsafe content. We may moderate or remove content at our discretion.
14) Intellectual Property
All site content (text, images, trademarks, logos) is owned by us or our licensors. You may not copy or exploit it without permission.
15) Limitation of Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under applicable law.
To the extent permitted by law, we’re not liable for: (a) losses not caused by our breach; (b) business losses (profit, revenue, data) where you purchase as a consumer; or (c) indirect or consequential losses. We do not exclude your statutory remedies under UK or EU consumer law.
16) Complaints & Dispute Resolution

UK ADR notice. Where a dispute cannot be resolved, UK law requires us to direct you to a certified Alternative Dispute Resolution (ADR) provider and state whether we will engage with them; participation is generally not mandatory for traders. EU ODR platform status. The European Commission’s ODR platform was discontinued on 20 July 2025. For advice on consumer redress in the EU, see the Commission’s guidance page. (European Commission)
You may also have the right to seek redress through your local courts or consumer authority.
17) Privacy
Your personal data is processed as described in our Privacy Policy.
18) Business Customers (non‑consumer purchases)
If you purchase wholly or mainly for business use:
(a) the 14‑day consumer cancellation right does not apply;
(b) warranties are limited to those expressly stated;
(c) our aggregate liability is limited to the price paid for the goods, except where liability cannot be limited by law.
19) Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control (e.g., strikes, carrier failures, extreme weather, supplier shortages, epidemics, regulatory changes, natural disasters).
20) Changes to these Terms
We may update these Terms to reflect changes in our services or the law. The version posted at checkout applies to your order.
